Splendor provides an object storage native data search and retrieval platform. Our Services enable you to ingest, index, and query structured and unstructured data using full-text keyword search, semantic search, SQL aggregations, and other retrieval methods. We store indexed data in object storage and provide search, export, and detection capabilities scoped to your tenant and datasets.

Your Data

By using our Services, you represent and warrant that:

• You have the authority to ingest and store the data you upload to the platform
• You have obtained all necessary consents and authorizations to process the data through our Services
• The data you ingest does not violate any applicable laws, regulations, or third-party rights
• You will not use our Services to store or process data in violation of applicable data protection laws

Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

Privacy and Data

Your use of the Services is also governed by our Privacy Policy. We treat your ingested data as confidential and implement appropriate security measures to protect it. Your data is logically isolated at the tenant level and is not accessible to other customers.

Intellectual Property

You retain all ownership rights to your data. We do not claim any ownership rights in the data you ingest into our platform. The Services and all content, features, and functionality are owned by Splendor and are protected by intellectual property laws.

Service Availability

While we strive for high availability and reliable search performance, we make no guarantee of uninterrupted access to the Services. Search results depend on the data you ingest and the schemas applied. You are responsible for verifying the completeness and accuracy of query results for your use case.

Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. SPLENDOR DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPLENDOR'S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNTS YOU PAID TO SPLENDOR IN THE TWELVE MONTHS PRECEDING THE CLAIM. IN NO EVENT SHALL SPLENDOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

Indemnification

You agree to indemnify and hold harmless Splendor and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising out of your use of the Services, your violation of these Terms, or your violation of any rights of another party.

Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in San Francisco County, California.

Changes to Terms

We may modify these Terms at any time. We will post the updated Terms on our website with a new effective date. Your continued use of the Services following the posting of revised Terms means that you accept the changes.
